- The buyer must place the order at least 2 working days in advance. In the event that an order submitted on time cannot be fulfilled, the Seller shall inform the Buyer at least 1 day before the planned date of fulfilment.
- The Seller can only execute the order after the Buyer has confirmed that the prices quoted for the order are suitable for him and the advance payment has been made. The delivery price includes unloading of the products. In the event that the unloading time indicated in the order confirmation is exceeded, the price indicated in the price list will apply and an (additional) invoice will be issued for the time exceeded.
- When ordering the Products, the Buyer selects the desired delivery time, according to which the Seller draws up the delivery schedule: i.e. the Seller assigns the number of vehicles agreed with the Buyer, determines the delivery schedule.
- On-site work starts within one hour of the time stated in the order confirmation. If there is a delay of up to 30 minutes between the arrival of the concrete trucks, this will not be considered as a delay.
- Tehnilise rikke (sõiduki või tootmisüksuse) korral kohustub Müüja asendama sõiduki või suunama olemasoleva sõiduki laadimiseks teise tootmisüksusesse 3 tunni jooksul alates rikke tekkimisest. Ostjal ei ole õigust esitada mingeid nõudeid seoses katkestusega, kui müüja on rakendanud meetmeid tarnete jätkamiseks.
- If the products are delivered to the Buyer by the Seller’s transport, the Buyer/Buyer’s representative (who accepts delivery) must:
- Taking into account the weight and dimensions of the vehicle delivering the products, access routes to the unloading point or construction site must be provided and indicated to the arriving driver. If the Buyer is unable to ensure the conditions for delivery of the Products, the driver shall inform the Seller’s responsible persons and the transport shall return to the loading point. In such a case, the Buyer shall be informed immediately and shall undertake to reimburse the Seller for all costs relating to the delivery, including the cost of the products ordered and the costs of disposal.
- Ensure that the driver who unloaded the products is directed to the vehicle cleaning area, taking into account the specificities of cleaning such special vehicles from residues – concrete mixers clean drums with water using high-pressure washers. Concrete pumpers – pipework is cleaned using compressed air and special equipment.
- The Buyer shall be responsible for arranging the transport and pumping of the concrete on site and the Seller shall not be liable for any loss or damage resulting from the Buyer’s failure to comply with the Buyer’s instructions or if the Buyer has not previously agreed in writing and informed the Seller of the possible risks. The limitation of liability shall also cover damage caused by the spraying of concrete residues during the cleaning of the work or machinery, damage to infrastructure or other property caused by the use of temporary roads on the construction site. The seller’s liability shall in no case exceed the value of the products ordered.
- If the Buyer does not provide and/or does not clearly indicate to the Seller access routes, safe working area, etc., the Seller has the right to refuse to unload the delivered Products and the Buyer is obliged to pay the Seller’s costs for the delivery of the Products.
- Before unloading the product, the Buyer must check the conformity of the goods with the order. In case of non-conformity, the Seller must be informed immediately. Acceptance of non-conforming products is the responsibility of the Buyer. In the event of a deterioration in the quality of the products due to the Buyer’s actions or omissions (change in the characteristics of the products due to prolonged unloading, use of products of poor quality, addition of additives, including water, without the agreement of the Seller), the Buyer must pay the value of the products, the transport costs and, where applicable, the costs of disposal.
- The Buyer shall pay the costs of the Seller’s representative’s attendance in accordance with the price list, except in the case of a justified complaint about non-conformity of the quality of the products. In such cases, the testing of the strength of the concrete by non-destructive methods, including the drawing up of a test report, shall be carried out free of charge at the request of the Purchaser.
- In the event of justified claims by the Buyer, the Seller undertakes to return the defective Products and to send an additional vehicle with new Products within 3 hours.
- The strength of concrete is determined by laboratory tests. Concrete samples are taken for testing. The production samples are tested in batches, each batch being subjected to a series of control tests in accordance with the requirements of the established standards. If the Purchaser wishes to have concrete samples taken and/or test specimens made, this must be stated in the order.
- The Seller has the right to suspend the execution of the order if, after acceptance of the order, it becomes apparent that the Buyer, who has been granted a payment deferral under the contract, is more than 30 days in arrears with payment of the invoices submitted to him by the Seller.
- The Seller has the right to suspend an order if the amount of the Buyer’s advance payment is less than the value of the order (including VAT).
- If the Seller suspends the performance of the order for the reasons set out in Clauses 11 or 12 of these Terms and Conditions, the Buyer shall not be entitled to any compensation for damages or loss of income (including downtime, transport costs, etc.).
- The working time for the transport of the delivery of the seller’s products is recorded on a digital delivery note, which serves as the basis for the calculation of the working time, and the actual delivery is invoiced.
- In the order, the buyer must specify the brand, quantity, delivery time, mode of delivery, exact place of delivery and his own details.
- The Buyer assumes full responsibility for the use of the products ordered, taking into account the intended purpose of the products and the environmental conditions in which they are used.
- The products must comply with the characteristics defined in the product-specific standard and in the declaration accompanying the products.
The processing of customers’ personal data is carried out in accordance with the EU General Data Protection Regulation and the legislation in force in the Republic of Estonia. - These Terms of Delivery shall apply to all orders placed by the Buyer, unless otherwise provided in the sales contract between the Buyer and the Seller.
